Lease ReviewKreines & Kreines, Inc. reviewed a proposed lease between a carrier and a local government for a personal wireless service facility to be located on city property. Here is what we found: · The proposed lease called for three carriers to share one equipment shelter. · Only one of the carriers would be paying rent to the city. · The city had already approved the application by zoning, but the plans for a Conditional Use Permit were different from the plans in the proposed lease. · The applicant would be pumping concrete into deep excavations on a flood plain with lease terms that excused the applicant from any damages from the excavations lower than two feet below grade. · The plans showed no generators although generator receptacles were shown for as many as three generators per equipment shelter. The city is reconsidering the proposed lease. |
