Reviewing Existing LeasesKreines & Kreines, Inc. has reviewed some existing local government leases and here is what we found: · The leases (with different carriers) had been assigned to tower companies. The city had no records of approvals of these assignments. · Sub-tenants had been added to the facilities without approval, either regulatorily (by zoning) or proprietarily (by lease), or both. · The exhibits that should be attached to the leases were either missing or inconsistent with the approval documents. · Neither the lease exhibits that did exist, nor the approval documents, reflected what was actually built on the leased area. · One of the assignees (a tower company) had submitted an application to the city for a modification and called the tower company the “Property Owner.” This was on a city-owned site that is only a short distance from the City Hall and the police station. |
